EMERGENT NEED TO AMEND INDIA’s ANTI-DEFCTION ACT, 1985

“This refers to the unethical and treacherous pulling down of democratically elected Govt of Puducherry by the BJP Govt in the Centre. The Anti-Defection Act, 1985 has become a mockery in the current context of MLAs/ MPs choosing the obnoxious route of resignation over defection and the BJP has been merrily encouraging this dubious method for pulling down any elected Govt led by the opposition parties as was seen in Karnataka and Puducherry. This undemocratic method is systematically adopted to subvert Article 190 (3) (b) of the Constitution as well. One is reminded of the prophetic words of Dr. Babasaheb Ambedkar: “However good a Constitution may be, it is sure to turn out bad if those who are called to work it happen to be a bad lot. However bad a Constitution may be, it may turn out to be good if those who are called to work it happen to be a good lot.” Our good Constitution is in the hands of bad people of every political party and the BJP tops this abhorring rank!

It is high time the Anti Defection Act was amended to ensure that those who resign for whatsoever be the reasons, shall stand disqualified to contest for a period of 5 years from the date of such resignation except with ticket of the same party to which he/she originally belongs and such disqualification clause must include even against nomination to the Lok Sabha, Rajya Sabha & State/UT Legislatures. Further such a disqualified Member shall not be eligible to hold any office of profit in the State as defined under Article 12 of the Indian Constitution.”
